STARIA COMPLIES WITH CALIFORNIA BEVERAGE ALCOHOL LAWS, AND IF YOU ATTEMPT TO PURCHASE OR RECEIVE BEVERAGE ALCOHOL BY PLACING AN ORDER ON STARIACOCKTAILS.COM WITHOUT BEING OF LEGAL AGE, WE MAY ASSIST LAW ENFORCEMENT IN PROSECUTING YOU TO THE FULLEST EXTENT OF THE LAW. YOU MUST BE LOCATED IN CALIFORNIA TO USE THIS SITE.

CHOICE OF LAW; ARBITRATION; AND CLASS ACTION WAIVE

The internal laws of the State of California, without regard to any otherwise applicable choice of laws principles, shall govern any action related to these Terms of Service, the use of the StariaCocktails.com website, or the business conducted therein. By using the site, you agree to resolve any dispute or claim through binding arbitration instead of litigation.

AGREEMENT TO ARBITRATE

All disputes must be resolved by binding arbitration. NEITHER PARTY SHALL HAVE THE RIGHT TO LITIGATE IN COURT OR TO HAVE A JURY TRIAL. DISCOVERY AND APPEAL RIGHTS ARE LIMITED IN ARBITRATION.

CLASS ACTION WAIVER

All arbitration must be conducted on an individual basis. YOU MAY NOT JOIN CLAIMS WITH OTHERS OR PARTICIPATE IN A CLASS ACTION OR SIMILAR REPRESENTATIVE PROCEEDING.

SALE OF ALCOHOLIC BEVERAGES

All orders are fulfilled by licensed California retailers. Neither those retailers nor Staria sell to individuals under the age of 21. By placing an order, you affirm that you are of legal age and that both your order and delivery locations are within California and legally allow the sale and delivery of alcoholic beverages. If any misrepresentation results in liability, you agree to indemnify Staria and its retail partners.

TITLE & OWNERSHIP

Title and ownership of all alcoholic beverages pass from the retailer to the purchaser at the time and location of fulfillment. It is the purchaser’s responsibility to ensure compliance with all applicable laws regarding transportation and receipt of alcoholic beverages.

ACCEPTANCE OF AND CHANGES TO TERMS OF SERVICE

By using this site, you accept these Terms of Service. If you do not agree, your sole remedy is to discontinue use. We may modify these Terms at any time by updating this page. Continued use of the site after such modifications constitutes acceptance of the changes.

USER OBLIGATIONS

Users must not violate any law or rights of others, misrepresent identity, engage in fraudulent activity, or misuse the website or its systems. Use of the site is strictly limited to personal use or gifting within California. Unauthorized access, scraping, or commercial resale is strictly prohibited.

THIRD PARTY CONTENT & MONITORING

Content provided by third parties does not represent Staria’s views. We are not responsible for the accuracy or reliability of such content.

PARENTAL CONTROL PROTECTION

Parental control protections are available commercially to assist in limiting access to material deemed harmful to minors. Staria does not endorse any specific provider.

VALIDATING YOUR ORDER

Orders are subject to verification and may be canceled or adjusted due to legal compliance, product availability, or suspected fraud.

ORDER ACCEPTANCE/CONFIRMATION

Receipt of an order confirmation does not signify order acceptance. Retailers may reject or cancel orders at their discretion.

RETURN POLICY

All sales are final. If your order arrives damaged, please contact support@stariacocktails.com within 48 hours with photos and details. Retailer resolution may include replacement or refund at their discretion.

ORDER LIMITATIONS

Staria reserves the right to reject or limit quantities for any order at its sole discretion.

SHIPPING

All orders are subject to product availability and shipped per our Shipping Policy. Notification of missing shipments must be received within 30 days of shipment confirmation.

ERRORS ON OUR SITE

We reserve the right to correct errors and cancel orders due to incorrect pricing or information.

MOBILE & MOBILE APPS

Mobile Terms of Service

The Staria mobile message service (the "Service") is operated by Staria (“Greenbar Distillery”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Staria’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Staria through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Staria. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18445371550 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Staria mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

TERMINATION OF USE

Staria may terminate access to the site at any time without notice. You remain liable for orders placed prior to termination.

FORCE MAJEURE

Staria is not liable for failure to perform due to acts beyond our control, including regulatory actions, natural disasters, or technological disruptions.

GENERAL PROVISIONS

These Terms remain in force even if a provision is deemed unenforceable. All rights not expressly granted are reserved by Staria.
